County man gets 3 1/2 to 5 years for not registering as sex offender

A Big Horn County man was recently sentenced to 3 1/2 to 5 years in prison for failing to register as a sex offender upon his release from custody in 2024.

Roger Tye Marchant, 40, was convicted of sexual assault in the first degree in August 2002, and with it came a lifetime registration requirement.

According to the affidavit, Marchant was released from the Big Horn County jail on April 23, 2024, on an order modifying the terms of his sentence.  A stipulation of that order required him to immediately leave Wyoming to reside with his mother in Clearwater, Fla., or to contact Probation & Parole to initiate supervised probation.

Marchant did neither, instead getting kicked out of the Western Motel in Lovell, where he was to remain until his family could arrange to get him to Florida, and not telling anyone where he was going.

Marchant eventually reached out to a family member, who later informed police that Marchant was “messed up,” staying somewhere in Cody and had no intentions of following the court order or of informing Probation & Parole of his whereabouts.

On the morning of April 26, police received two more tips — the first suggesting that Marchant was with a man he’d met in prison, the second indicating he was “drunk” and refusing to leave the Big Bear Hotel in Cody.

On March 3, 2025, Marchant agreed to plead guilty to Count III of the information, alleging that, as a sex offender, he failed to update his information within three working days in person to the sheriff of the county in which he is registered (Big Horn).

In return, prosecutors agreed to dismiss Count I and Count II, also alleging failure to register as a sex offender.

As part of his sentence, Marchant was given credit for 247 days previously served and ordered to pay a $40 court automation fee, a $10 civil legal services fee, $150 for victim’s compensation and a $75 ASI fee.
